Thank you for using Octo!

These Terms of Use apply to your use of Octo's AI chat assistant and our other services for individuals, along with any associated software applications and websites (all together, "Services"). These Terms form an agreement between you and Octo, and they include important provisions for resolving disputes. By using our Services, you agree to these Terms.

Our Privacy Policy explains how we collect and use personal information. Although it does not form part of these Terms, it is an important document that you should read.

Who We Are

Octo is an AI-powered conversational assistant designed to provide safe, educational, and engaging interactions, especially for children. Our mission is to create a secure and nurturing digital environment where children can learn, explore, and have meaningful conversations with AI technology. Registration and Access

Minimum Age

You must be at least 18 years old to create and manage a parent/guardian account. The Services are designed for children ages 4–13 and may be used only under a parent or legal guardian’s supervision and account, with verifiable parental consent where required by law (for example, under 13 in the United States).

Guest Access

We offer guest access for users who wish to try our Services without creating an account. Guest sessions are temporary and may have limited functionality compared to registered accounts.

Registration

You must provide accurate and complete information to register for an account. You may not share your account credentials or make your account available to anyone else and are responsible for all activities that occur under your account. If you create an account or use the Services on behalf of another person or entity, you must have the authority to accept these Terms on their behalf.

Parental Controls

For users under 18, parents or legal guardians may set up parental control features including:

  • Chat history monitoring and review
  • Content filtering and safety guardrails
  • Usage time limits and restrictions
  • Password-protected settings management

Using Our Services

What You Can Do

Subject to your compliance with these Terms, you may access and use our Services to:

  • Have conversations with our AI assistant
  • Access educational and entertainment content appropriate for your age
  • Customize your experience through settings and preferences
  • Use parental control features (for parents/guardians)
  • Create and manage custom safety guardrails (for registered users)

In using our Services, you must comply with all applicable laws as well as our Community Guidelines and any other documentation, guidelines, or policies we make available to you.

What You Cannot Do

You may not use our Services for any illegal, harmful, or abusive activity. For example, you may not:

Prohibited Uses:

  • Use our Services in a way that infringes, misappropriates, or violates anyone's rights
  • Attempt to bypass or disable safety features, guardrails, or parental controls
  • Use the Services to generate, share, or request inappropriate content, especially content that could harm children
  • Modify, copy, lease, sell, or distribute any of our Services
  • Attempt to reverse engineer, decompile, or discover the source code or underlying components of our Services, including our models, algorithms, or systems
  • Automatically or programmatically extract data or conversations from our Services
  • Represent that AI-generated content was human-generated when it was not
  • Interfere with or disrupt our Services, including circumventing rate limits or security measures
  • Use our Services to develop competing AI models or services
  • Impersonate another person or provide false information about your identity
  • Use the Services for commercial purposes without our express written permission
  • Attempt to manipulate, trick, or confuse the AI assistant into bypassing safety protocols

Child Safety Violations:

  • Attempt to collect personal information from other users, especially minors
  • Share inappropriate content with or expose minors to harmful material
  • Use the Services to groom, exploit, or harm children in any way
  • Attempt to bypass parental controls or safety measures designed to protect children

Software

Our Services may allow you to download software, such as mobile applications, which may update automatically to ensure you're using the latest version. Our software may include open source software that is governed by its own licenses that we've made available to you.

Third Party Services

Our Services may include third party software, products, or services ("Third Party Services") and some parts of our Services may include output from those services ("Third Party Output"). Third Party Services and Third Party Output are subject to their own terms, and we are not responsible for them.

Feedback

We appreciate your feedback, and you agree that we may use it without restriction or compensation to you.

Content

Your Content

You may provide input to the Services ("Input"), and receive output from the Services based on the Input ("Output"). Input and Output are collectively "Content." You are responsible for Content, including ensuring that it does not violate any applicable law or these Terms. You represent and warrant that you have all rights, licenses, and permissions needed to provide Input to our Services.

Ownership of Content

As between you and Octo, and to the extent permitted by applicable law, you:

  1. Retain your ownership rights in Input
  2. Own the Output, subject to the limitations described in these Terms

We hereby assign to you all our right, title, and interest, if any, in and to Output, subject to our right to use Content as described in these Terms.

Similarity of Content

Due to the nature of our Services and artificial intelligence generally, output may not be unique and other users may receive similar output from our Services. Our assignment above does not extend to other users' output or any Third Party Output.

Our Use of Content

We use Content to provide, maintain, and improve the Services and to comply with law. We do not use children’s conversations or related content to train our models by default; such content is processed only to provide the Services (e.g., safety filtering, speech‑to‑text transcription, text‑to‑speech generation, and reporting for parents). For adult users, we may use Content to improve our Services; you may opt out. Where we rely on third‑party AI providers, your Content may be processed by them to deliver the requested feature; we configure “no‑training” modes where available and contractually restrict provider use of your data.

Parental Access to Content

For users under 18 with active parental controls, parents or legal guardians may access chat history and conversation content as part of our parental monitoring features. This access is designed to ensure child safety and may include:

  • Reviewing conversation history
  • Monitoring flagged or inappropriate content
  • Accessing usage statistics and analytics

Opt Out

If you do not want us to use your Content to train our models, you can opt out by contacting us at support@octo.toys. Please note that in some cases this may limit the ability of our Services to better address your specific use case.

Safety and Content Moderation

We use automated safety systems (and human review where available) to monitor conversations for safety, especially for interactions involving minors. This includes:

  • Real-time content filtering and safety guardrails
  • Flagging and review of potentially inappropriate content
  • Automatic blocking of harmful or dangerous content
  • Reporting of serious safety concerns to appropriate authorities when required by law

Accuracy

Artificial intelligence and machine learning are rapidly evolving fields of study. We are constantly working to improve our Services to make them more accurate, reliable, safe, and beneficial. Given the probabilistic nature of machine learning, use of our Services may, in some situations, result in Output that does not accurately reflect real people, places, or facts.

Important Disclaimers:

  • Output may not always be accurate and should not be relied upon as a sole source of truth or factual information
  • You must evaluate Output for accuracy and appropriateness before using or sharing it
  • You must not use any Output relating to a person for any purpose that could have a legal or material impact on that person
  • Our Services may provide incomplete, incorrect, or offensive Output that does not represent Octo's views

Our Intellectual Property Rights

We and our affiliates own all rights, title, and interest in and to the Services, including all software, models, algorithms, and systems. You may only use our name and logo in accordance with our Brand Guidelines (when available).

Paid Accounts

Billing

If you purchase any paid Services, you will provide complete and accurate billing information, including a valid payment method. For paid subscriptions, we will automatically charge your payment method on each agreed-upon periodic renewal until you cancel. You're responsible for all applicable taxes, and we'll charge tax when required.

Cancellation

You can cancel your paid subscription at any time through your account settings or by contacting us. Payments are generally non-refundable, except where required by law or as specified in these Terms.

Changes to Pricing

We may change our prices from time to time. If we increase subscription prices, we will give you at least 30 days' notice, and any price increase will take effect on your next renewal so that you can cancel if you do not agree to the price increase.

Termination and Suspension

Your Right to Terminate

You are free to stop using our Services at any time by discontinuing use and, for registered users, deleting your account.

Our Right to Suspend or Terminate

We reserve the right to suspend or terminate your access to our Services or delete your account if we determine:

  • You breached these Terms or our policies
  • We must do so to comply with the law
  • Your use of our Services could cause risk or harm to Octo, our users (especially children), or anyone else
  • You have been inactive for over a year without a paid account

For violations involving child safety, we may suspend or terminate access immediately without prior notice.

Appeals

If you believe we have suspended or terminated your account in error, you can file an appeal by contacting our Support team at support@octo.toys.

Disclaimers

Service Availability

We strive to keep our Services available and functional, but we cannot guarantee uninterrupted access. Our Services are provided "as is" without warranties of any kind.

AI Limitations

Our AI assistant is a computer program that generates responses based on training data and algorithms. It:

  • May provide incorrect, incomplete, or inappropriate responses
  • Cannot replace human judgment, professional advice, or supervision
  • Should not be relied upon for important decisions, especially those affecting children's safety or well-being
  • May not understand context or nuance in the same way humans do

Parental Responsibility

While we provide tools to help keep children safe, parents and guardians remain responsible for:

  • Supervising their children's use of our Services
  • Setting appropriate limits and guidelines
  • Reviewing conversation history and monitoring usage
  • Teaching children about online safety and appropriate behavior

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We Are Not Liable For:

  • Any indirect, incidental, special, consequential, or exemplary damages
  • Damages for loss of profits, goodwill, use, or data
  • Any damages resulting from your use of or inability to use our Services
  • Any harm that results from reliance on AI-generated content
  • Any issues arising from interactions between users

Our Total Liability is limited to the greater of:

  • The amount you paid for the Services in the 12 months before the liability arose, or
  • One hundred dollars ($100)

Important Exception: Nothing in these Terms limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded by law

Some jurisdictions do not allow certain warranty disclaimers or liability limitations, so some of the above may not apply to you.

Indemnification

If you are a business or organization, you agree to indemnify and hold harmless Octo, our affiliates, and our personnel from any costs, losses, liabilities, and expenses (including attorneys' fees) arising from:

  • Your use of the Services
  • Your breach of these Terms
  • Your violation of any law or regulation
  • Claims by third parties related to your use of our Services

Dispute Resolution

Informal Resolution

Before filing any legal claim, we encourage you to contact us first to try to resolve the dispute informally. You can reach us at support@octo.toys. We will work in good faith to resolve any concerns.

Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes will be resolved in the courts of England and Wales unless otherwise specified below.

Arbitration (For Users 18 and Over)

For users 18 years of age and older, disputes may be subject to binding arbitration. Specific arbitration procedures will be provided separately and you may opt out within 30 days of account creation.

Note: Disputes involving minors or child safety issues may be exempt from arbitration requirements and may be resolved in court.

Child Safety and Reporting

We take child safety extremely seriously and have implemented multiple layers of protection:

  • AI-powered content filtering and safety guardrails
  • Human review where available
  • Parental control and monitoring tools
  • Regular safety audits and improvements

Reporting Concerns

If you encounter any content or behavior that raises child safety concerns, please report it immediately:

  • Emergency: If you believe a child is in immediate danger, contact local law enforcement immediately

We will investigate all reports promptly and take appropriate action, which may include:

  • Removing harmful content
  • Suspending or terminating accounts
  • Reporting to appropriate authorities as required by law
  • Implementing additional safety measures

Mandatory Reporting

We may be required by law to report certain types of content or behavior to appropriate authorities, including:

  • Suspected child abuse or neglect
  • Threats of violence or self-harm
  • Illegal activities involving minors

International Use

Our Services are operated from the United Kingdom and may not be available in all countries. If you use our Services from outside the United Kingdom, you are responsible for compliance with local laws.

Changes to These Terms

We may update these Terms from time to time to reflect:

  • Changes in law or regulation
  • New features or services
  • Security or safety improvements
  • Other business needs

For material changes that adversely affect your rights, we will provide at least 30 days' notice via email or in-app notification. Other changes will be effective immediately upon posting. If you do not agree to the changes, you must stop using our Services.

General Terms

Assignment

You may not assign or transfer any rights or obligations under these Terms. We may assign our rights or obligations to any affiliate, subsidiary, or successor.

Severability

If any portion of these Terms is found to be invalid or unenforceable, the remainder will continue in effect to the maximum extent possible.

Entire Agreement

These Terms, together with our Privacy Policy and any other referenced policies, constitute the entire agreement between you and Octo regarding the Services.

Language

These Terms are written in English. Any translations are provided for convenience only, and the English version controls in case of conflicts.

Force Majeure

We will not be liable for any delays or failures due to circumstances beyond our reasonable control, including natural disasters, government actions, or technical failures.

Creating a Safe and Positive Environment

Our Community Guidelines work alongside these Terms of Use to ensure Octo remains a safe, educational, and positive environment for all users, especially children.

Expected Behavior

Be Kind and Respectful:

  • Treat the AI assistant and the community with respect
  • Use polite and friendly language
  • Ask questions and engage in positive conversations

Stay Safe:

  • Never share personal information like your address, phone number, or school name
  • Don't try to meet people you've talked to through Octo
  • Tell a trusted adult if anything makes you uncomfortable

Learn and Explore:

  • Use Octo to learn new things and explore interesting topics
  • Ask questions about subjects that interest you
  • Be curious and creative in your conversations

Prohibited Behavior

Never Try To:

  • Get the AI to say inappropriate things
  • Share or request harmful, scary, or adult content
  • Bully, threaten, or be mean to others
  • Pretend to be someone else
  • Break or damage the service

Parents and Guardians Should:

  • Monitor their children's use of the service
  • Review chat history regularly
  • Set appropriate usage limits
  • Report any concerns immediately

Consequences

Violations of our Community Guidelines may result in:

  • Warnings or educational messages
  • Temporary restrictions on service use
  • Account suspension or termination
  • Reporting to parents/guardians (for minor users)
  • Contact with appropriate authorities (for serious violations)
